Terms of Service

1. Acceptance of Terms

By accessing Pyzando and creating an account, you agree to be bound by these Terms of Service, our Privacy Policy, and our AML/CFT Policy (Anti-Money Laundering / Counter-Financing of Terrorism). If you do not accept any of these terms, you must not use our services.

We reserve the right to modify these terms at any time. Material changes will be notified by email or via the platform with at least 30 days' notice. Continued use of the platform after the effective date of the changes constitutes acceptance of those changes.

2. Eligibility

To use Pyzando's services, you must:

• Be at least 18 years of age;
• Be a legally constituted natural or legal person capable of entering into contracts;
• Carry out a legal and registered business activity in your country of residence or incorporation;
• Be able to provide us with KYC information required by regulations;
• Not appear on any international (UN, OFAC, EU, etc.) or national sanctions list;
• Not have been previously excluded from our services.

By creating an account, you represent and warrant that you meet all of these conditions. Pyzando reserves the right to verify your eligibility at any time and to suspend or terminate your account in case of non-compliance.

3. Account Registration and KYC Verification

You undertake to provide accurate, complete, and up-to-date information when registering and to keep it updated throughout your relationship with Pyzando.

In accordance with our legal obligations under Law n°04/016 of July 19, 2004 and applicable national regulations on electronic money, Pyzando applies an identity verification (KYC — Know Your Customer) procedure that includes:

• Verification of an official identity document (national ID, passport);
• Verification of mobile phone number;
• For legal entities: presentation of articles of association, RCCM registration, and identification of beneficial owners;
• Enhanced verification for high-risk customers (politically exposed persons, large transactions, etc.).

You consent to Pyzando retaining this information in accordance with its Privacy Policy and applicable regulations, and sharing it with competent authorities (CENAREF and other authorized authorities) when required by law.

Your account is personal and non-transferable. You are responsible for the confidentiality of your access credentials and for all activities carried out under your account.

4. Description of Services

Pyzando provides a platform enabling merchants to:

• Create personalized payment links;
• Accept payments via mobile money (M-Pesa Vodacom, Airtel Money, Orange Money, etc.);
• Track their transactions in real time from a dashboard;
• Withdraw funds to their mobile money account;
• Configure webhooks to receive real-time payment notifications;
• Generate invoices and payment receipts.

Pyzando acts as a technical intermediary for payment processing. Payments are executed by licensed mobile money operators. Pyzando does not hold a banking license but operates in partnership with payment service providers licensed by competent authorities.

5. Fees and Pricing

Pyzando charges a flat fee of 11% on each transaction (deposits and withdrawals). This fee is automatically deducted from each incoming or outgoing payment amount. There are no monthly fees, account opening fees, or hidden charges.

Example: If a customer pays 100 CDF via a Pyzando link, you receive 89 CDF and Pyzando retains 11 CDF as its service fee.

Pyzando reserves the right to modify its pricing structure with at least 30 days' notice. New pricing terms will not apply retroactively to already-processed transactions.

All amounts billed are expressed in the transaction currency. Pyzando may apply a conversion rate if currency conversions are required.

6. Wallet and Withdrawals

Funds received via your payment links are credited to your Pyzando wallet after settlement by the partner mobile money operator. Settlement times depend on operators and may vary.

Withdrawals to your mobile money number are subject to processing times and the availability of partner networks. Pyzando does not guarantee a specific withdrawal time but undertakes to process requests as quickly as possible.

Pyzando reserves the right to block or delay any withdrawal in the following cases:

• Suspicion of fraudulent activity or non-compliant use;
• Legal obligation (asset freeze, investigation by competent authorities);
• Ongoing KYC non-compliance;
• Insufficient balance to cover processing fees.

7. Merchant Obligations — Prohibited Uses

By using Pyzando's services, you agree to:

• Use the platform only for legal purposes in compliance with Congolese and international regulations;
• Not use Pyzando to receive or send payments linked to illegal activities;
• Comply with applicable national regulations and the provisions of Law n°04/016 on money laundering and terrorism financing;
• Not impersonate any other person or entity;
• Not attempt to circumvent transaction monitoring mechanisms implemented by Pyzando.

The following activities are strictly prohibited on the platform:

• Money laundering or terrorist financing (as defined under Law n°04/016);
• Transactions linked to drug trafficking, arms dealing, human trafficking, or trade in protected species;
• Illegal gambling;
• Fraud, phishing, credit card or mobile money scams;
• Undeclared currency trading;
• Transactions related to corruption of officials or bribery;
• Any activity sanctioned by UN, OFAC, or European Union sanctions lists;
• Technical circumvention of the platform (API manipulation, unauthorized access attempts);
• Use of bots or automated processes aimed at defrauding the platform.

In the event of a breach of these rules, Pyzando reserves the right to immediately suspend or terminate your account, freeze the funds concerned, and report suspicious activity to CENAREF and competent authorities, in accordance with its legal obligations.

8. Disputes and Refunds

Pyzando is a technical intermediary and is not responsible for commercial disputes between the merchant and their customers. It is the merchant's responsibility to manage their own refund policy with respect to their customers.

In the event of an unauthorized transaction, technical error, or proven fraud, please contact our support at contact@pyzando.com within 30 days of the date of the relevant transaction.

9. Intellectual Property

All elements of the Pyzando platform (brand, logo, interface, source code, documentation) are the exclusive property of Pyzando and are protected by applicable intellectual property laws. Any unauthorized reproduction, modification, or use is prohibited.

10. Limitation of Liability

To the extent permitted by Congolese law, Pyzando shall not be liable for indirect, incidental, special, or consequential damages resulting from the use or inability to use its services.

Pyzando's total liability to you is limited to the amount of service fees you have actually paid in the 3 months preceding the event giving rise to the claim.

Pyzando shall not be liable for service interruptions caused by factors beyond its control, including mobile money operator outages, internet disruptions, natural disasters, or decisions by regulatory authorities.

11. Termination

Termination by the merchant: You may close your account at any time by contacting our support at contact@pyzando.com. Any available balance will be returned to you after deduction of applicable fees and verification of regulatory obligations.

Termination by Pyzando: We may suspend or terminate your account, with or without notice, in the event of:

• Breach of these Terms;
• Suspicious activity identified by our monitoring systems;
• Decision by a regulatory or judicial authority;
• Extended account inactivity (more than 12 consecutive months).

12. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of the Democratic Republic of Congo. Any dispute relating to the interpretation or performance of these Terms shall be submitted to the exclusive jurisdiction of the courts of Kinshasa (DRC), subject to any mandatory provisions of local law applicable in the user's country of residence.
